Thank you for visiting Umniah eServices (henceforth the "Portal"). The Portal is comprised of various websites owned and maintained by Umniah, each a "Umniah Website".
Umniah wants you to have a safe and pleasurable visit, so we have established the following Terms and Conditions (the "Terms") so that we (Umniah and you) know what to expect from each other. The Terms will form the agreement under which you may use the Portal.
The expressions "you" and "user" as used in the Terms refer to all individuals and/or entities accessing and using the Portal for any reason.
The section titles in these Terms are for your convenience only and do not have any legal or contractual effect.
By accessing and using the Portal and any of Umniah Websites in any way, you expressly understand, acknowledge and agree to be bound by the Terms set forth herein as well by any applicable additional terms and conditions that govern individual products and services provided by Umniah, including the Acceptable Use Policy (AUP) and Fair Usage Policy (FUP). If you do not agree with these Terms, please do not use the Portal.
These Terms will remain in full force and effect as long as you are a user of the Portal or any of Umniah Websites and in the event of termination of any service or feature, you will still be bound by your obligations under these Terms, including any indemnifications, warranties, and limitations of liability.
To the extent that there is a conflict between these Terms and any additional applicable terms, the latter shall govern.
Umniah may modify these Terms at any time at its sole discretion, and such modifications shall be effective immediately upon posting of the modified Terms at www.umniah.com/eservices. You agree to review the Terms periodically to be aware of such modifications and your continued access to or use of the Portal shall be deemed your conclusive acceptance of the modified Terms and of the reasonableness of these standards for notice of changes.
Umniah reserves the right, at its sole discretion and at any time, to modify or discontinue the Portal (or any part thereof), on a temporary or permanent basis, with or without notice. You understand, acknowledge and expressly agree that Umniah will not be liable to you or to any third party for any such modification, suspension or discontinuance of the Portal.
The Portal contains hyperlinks to websites and other resources owned and operated by third parties, including the websites of Umniah's advertisers, which are neither maintained nor controlled by Umniah. Use of any hyperlinks and access to such hyperlinked websites are entirely at your own risk.
You expressly understand and agree that Umniah is not responsible for the availability of such external websites or resources and does not make any representation to you about those websites or the materials available there. That Umniah has made those hyperlinks available to you is solely as an added convenience to you and not as an endorsement or recommendation of any of those websites. Nor shall Umniah be liable for any aspect of the content (including without limitation compliance with intellectual property, proprietary or publicity rights), advertising or business practices (including without limitation privacy policies), products, or any other materials on or available at such third-party websites or resources.
Umniah will not, under any circumstances, be responsible or liable, directly or indirectly, for any damage or loss of any kind caused or alleged to be caused by or in connection with your use of or reliance on any such content, advertising or business practices, products or services available on or through any such hyperlinked third party websites or resources.
As a condition of your use of the Portal, you warrant to Umniah that you will not use the Portal for any purpose that is unlawful or prohibited under applicable law or under these Terms.
You agree not to cause, nor knowingly allow others to cause, any nuisance, annoyance, or inconvenience, whether to Umniah or any of its customers or users of the Portal by any means.
You expressly agree not to use the Portal to post, transmit, distribute, link to, or solicit content that:
(i) contains any advertising or promotional message not expressly authorised by Umniah;
(ii) violates any applicable laws or regulations;
(iii) violates any intellectual property, proprietary, privacy or publicity rights of any person;
(iv) undermines the security or integrity of the Portal, including without limitation by introducing any viruses, worms, Trojan horses, logic bombs or other disabling devices;
(v) is unlawful, harmful, threatening, abusive, obscene, indecent, libelous, disruptive, hateful, infringing, or racially, ethnically or otherwise objectionable;
(vi) contains any material in any form that would otherwise render Umniah liable or exposed to any proceedings whatsoever.
Umniah reserves the right to refuse, remove or disable any content that is, at its sole discretion, considered to be in breach of the above and reserves the right to expel users and prevent their further access to the Portal for violating these Terms or any applicable laws or regulations.
If any portion of the Portal requires you to register or open an account, you must provide true, accurate, complete, and updated information. You may also be asked to choose a login name and a password. Please select a password that you can remember but does not use information that would be obvious to someone trying to guess your password, and change it regularly as an added precaution.
You shall not disclose your password to any person and shall not permit or authorize any person to use your login name or password for any purpose whatsoever.
Portions of the Portal are to be accessed only by registered users, who should have only one unique user name with one unique password. If you are found to share your password with any non-registered user, Umniah may terminate your access to those portions of the site immediately without notice.
You are responsible for maintaining the confidentiality of your password and account and are fully responsible for all activities that occur under your password or account identification. Umniah may treat any access to or use of the Portal via your login name and password as access by you, even if used by another person without your knowledge or authority.
You agree to immediately notify Umniah of any unauthorized use of your password or account or any other breach of security. Umniah will not be liable for any loss or damage you may incur as a result of someone else using your password or account, whether with or without your knowledge. You may not use anyone else's account at any time without the account holder's permission.
During your use of the Portal, we may issue to and request from your computer small blocks of data known as "cookies" to enable more convenient browsing and to better serve you when you revisit the Portal. A cookie is a small amount of data, often including a unique identifier, that is sent from the Portal to your device browser and stored on your device's hard drive. Storing cookies does not have any adverse effect on your device.
You must not alter any cookies sent to your device from the Portal and you must ensure that your device sends correct and accurate cookies in response to any relevant request from the Portal.
You may not use the Portal in any way that could damage, impair, or interfere with the proper functioning of the Portal or any other party's use of it. The following actions are prohibited:
(i) Accessing data not intended for you or logging into an account you are not authorized to access;
(ii) Attempting to probe, scan, or test the vulnerability of the system or network or to breach security or authentication measures without proper authorization;
(iii) Forging headers or otherwise manipulating identifiers in order to disguise the origin of any transmission through the Portal;
(iv) Attempting to interfere with the functionality of the Portal, including without limitation submitting viruses, overloading, "flooding," "spamming," "mailbombing," or "crashing" the system;
(v) Sending unsolicited commercial emails individually or in bulk (Spam);
(vi) Harvesting email addresses from the Portal via automated processes;
(vii) Bypassing the Portal homepage via deep linking or framing the Portal or any Umniah webpage or content without written permission from Umniah. Hyperlinking to the Portal for commercial purposes via email is also prohibited without express permission;
(viii) Attempting to gain unauthorized access to Portal features, interfering with or manipulating the registration process;
(ix) Falsifying identity or impersonating another person or entity;
(x) Creating fake or mirror sites, copying or replicating content, structure, or functionality of the Portal.
Violations of the system or network security may result in civil or criminal liability. Umniah may investigate any violations and cooperate with relevant authorities or third parties (such as employers or telecom service providers) in taking appropriate legal action.
Umniah reserves the right to terminate access to the Portal for any user who, in its sole judgment, is found to have breached security provisions.
Umniah is committed to safeguarding your personal information. "Personal information" refers to all and any information relating to you, including but not limited to your name, contact number, email address, and mailing address, obtained by Umniah through your access to or use of this Portal.
Whenever you provide such information, Umniah is legally obligated to use it in accordance with all applicable laws regarding personal data protection, including but not limited to the Data Protection Act (or relevant local legislation).
You understand and agree that the personal information you choose to provide may be collected, held, and used by Umniah for purposes including but not limited to:
(i) Processing orders or applications, managing your account, performing credit checks, and providing requested products and/or services;
(ii) Responding to inquiries, complaints, or other customer service-related matters;
(iii) Conducting market analysis and improving products and services;
(iv) Contacting you (via email, phone, SMS, etc.) about Umniah's offerings or those of carefully selected third-party partners (unless you opt out);
(v) Enrolling you in loyalty programs, promotional campaigns, or other benefits-based initiatives;
(vi) Including your details in directories or inquiry services where applicable;
(vii) Complying with legal, governmental, or regulatory obligations, including those related to fraud prevention or legal proceedings;
(viii) Performing internal activities such as employee training, quality control, system maintenance, and network monitoring.
You also agree that Umniah may use your personal data for other purposes reasonably connected to those described above, such as keeping you informed about new features or upgrades to Umniah's services.
Umniah will not use your personal data for any unrelated purpose without your consent and will retain your data only as long as necessary to fulfill legal or business obligations.
Your information will never be sold or disclosed to third parties without your consent, unless required by law. Umniah may, however, share your data with government or law enforcement agencies when legally required.
Additionally, Umniah may transfer your personal data to vendors, partners, or service providers located outside of your country if necessary for service delivery or support. These parties will be contractually obligated to provide the same level of data protection.
Please be aware that any data you disclose publicly on the Portal (e.g., via forums, chat features, or bulletin boards) becomes public and is not protected under this Privacy clause. Exercise caution before sharing personal information in such areas.
By using this Portal and providing your personal information, you expressly consent to Umniah's collection, processing, storage, and transfer of your data as outlined in this Privacy section.
The content on the Portal is intended to appeal to a wide range of audiences; however, not all content may be suitable for children. Parents and guardians are reminded of the importance of supervising young children when they access or use the Internet.
Where Umniah provides interactive services such as forums, chat rooms, or bulletin boards, parents and guardians are fully responsible for the actions of any children using these services under their supervision.
You expressly understand and agree that you assume full responsibility and risk for your use of the Portal and the Internet. If your use of the Portal, software, or any content results in the need for servicing or replacing equipment or data, you acknowledge and agree that Umniah is not responsible for those costs.
The information and content available on the Portal are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Umniah makes no warranties, representations, or endorsements of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or accuracy regarding the Portal, its content, or services offered through it.
Umniah will make reasonable efforts to keep the Portal functional and its contents accurate. It may also take industry-standard precautions to secure the Portal. However, Umniah does not guarantee or warrant that:
(a) The Portal will meet your requirements or always be accessible;
(b) The Portal will be uninterrupted, timely, secure, error-free, or free from viruses or harmful code;
(c) The results obtained from the use of the Portal will be accurate or reliable;
(d) The quality of any products, services, or content accessed through the Portal will meet your expectations;
(e) Any errors or issues in the Portal will be corrected.
You understand that the security, availability, and performance of Internet-based platforms are outside of Umniah's control.
You agree to defend, indemnify, and hold harmless Umniah, its parent company, affiliates, officers, directors, employees, agents, suppliers, licensors, and content providers from and against any claims, demands, liabilities, damages, losses, or expenses (including legal and accounting fees) arising from:
Your access to or use of the Portal;
Your violation of these Terms;
Your violation of any third-party rights;
Or any misuse of the Portal in any form.
These obligations will survive termination of your use of the Portal.
If such a claim, suit, or proceeding arises, Umniah will make reasonable efforts to notify you. If requested, and at your expense, Umniah may assist you in defending the matter, although Umniah reserves the right to assume exclusive control of the defense and require your cooperation.
To the fullest extent permitted under applicable law, Umniah shall not be liable for any direct or indirect, special, incidental, consequential, or punitive damages arising out of or related to:
Your use or inability to use the Portal;
Delays or failures in transmission;
Errors or inaccuracies in content;
Performance or unavailability of the Portal;
Or loss of data, revenue, business, or opportunity.
This applies regardless of the form of action, whether in contract, tort (including negligence), or otherwise—even if Umniah has been advised of the possibility of such damages.
Notwithstanding anything to the contrary, Umniah's total aggregate liability for any claim or series of claims related to your use of the Portal shall be limited to the total amount paid to Umniah by you (if any) for the use of the Portal. Multiple claims will not increase this limit.
The contents of the Portal—including but not limited to information, communications, software, design, text, graphics, artwork, images, and sounds available on or through the Portal—are provided by Umniah, its content providers, and third-party licensors. All intellectual property rights in the content of the Portal and each of Umniah's websites are owned by Umniah, its content providers, and/or third-party licensors. All rights are reserved.
The content on the Portal and Umniah's websites may not be reproduced, modified, transferred, distributed, republished, downloaded, posted, or transmitted in any form or by any means—electronic, mechanical, photocopying, recording, or otherwise—without prior written permission from Umniah. You agree that all material and content from the Portal is for your personal, non-commercial use only and may not be used or distributed for commercial purposes.
Your access to or use of the Portal does not grant—by implication, estoppel, or otherwise—any license or right to use any trademarks, tradenames, logos, or service marks appearing on the Portal without the prior written consent of Umniah. You may not use any such marks as a hyperlink to the Portal or to any other Umniah website without prior written consent.
You may not modify, translate, decompile, disassemble, reverse engineer, or attempt to derive the source code of the computer systems or other technology underlying the Portal. For these Terms, "reverse engineering" includes analyzing the Portal to determine its source code, structure, organization, design, algorithms, or encryption mechanisms.
If any provision of these Terms, or its application to any person or circumstance, is held to be invalid or unenforceable by a court of competent jurisdiction, that provision will be deemed severable and will not affect the validity and enforceability of the remaining provisions.
Umniah's failure to insist on or enforce strict performance of any provision of these Terms will not be construed as a waiver of any provision or right.
These Terms and Conditions are available in both Chinese and English. In case of any inconsistency or conflict of interpretation, the Chinese version shall prevail.
Your access to and use of the Portal, along with these Terms, shall be governed by and construed in accordance with the laws of the MSAR. The courts of the MSAR shall have jurisdiction over any disputes arising from your use of the Portal or these Terms. However, Umniah reserves the right to bring proceedings against you in your country of residence for breach of these Terms.
Customers may terminate a contract for non-commercial mobile or Internet services registered under a private name and applied for via Umniah's telemarketing center, service hotline, or online channel within seven (7) days from the date of contract execution.
To exercise this right, the Customer must apply for termination within the above period and will be responsible for any expenses related to the refund or return of products. Umniah will begin providing the service only after this period ends—unless the Customer expressly requests service within the seven-day period. In such a case, if the Customer terminates during that period, they must pay a pro-rata fee for the service already provided up to the date of termination.
For any redeemed or purchased Gift via Umniah's online channel by a non-commercial bonus point account registered in a private name, the Customer may cancel the redemption or purchase within seven (7) days of the redemption date.
To do so, the Customer must apply for cancellation within that period and is responsible for any costs related to the return or refund (including, but not limited to, payment service charges, and delivery or collection fees). Umniah or the Merchant will deliver the service only after the seven-day window unless the Customer explicitly requests earlier service. If cancellation is made after early service delivery, the Customer will be charged or have points deducted based on services already provided up to the cancellation notice.
If the Gift includes product(s), the seven-day cancellation period begins from the date the Customer receives the product(s). Upon cancellation, the Customer must return the product(s) to Umniah or the Merchant. However, if the product(s) have been unsealed, installed, or cannot be returned for other reasons, no refund will be made, and the redeemed points or payment will not be returned. In such cases, the Customer shall also pay Umniah a penalty, if applicable.
